CHANGES TO THE PACKAGE AGREEMENT

TO THE EXTENT THAT ‘PERMITTED BY APPLICABLE LAW, STREAMAMG , ITS AFFILIATES AND ANY OF DIRECTORS ITS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS AND / OR SUPPLIERS OF THE ABOVE WILL NOT BE LIABLE FOR ANY INDIRECT, PUNITIVE, ACTUAL, CONSEQUENTIAL, INCIDENTAL, SPECIAL OR EXEMPLARY DAMAGES OF ANY KIND AND FOR ANY REASON WHATSOEVER ARISING IN CONNECTION WITH THIS AGREEMENT AND / OR THE SERVICE, REGARDLESS OF THE REASONS WHICH IS BASED ON THE LIABILITY REQUEST, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, TO THE EXTENT THAT ‘PERMITTED BY APPLICABLE LAW, STREAMAMG , ITS AFFILIATES AND ANY OF ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS AND / OR SUPPLIERS OF THE ABOVE HAVE NO LIABILITY’ FOR DAMAGES OR INJURY CAUSED IN WHOLE OR IN PART, FROM CONTINGENCIES OR PROBLEMS INDEPENDENT FROM THEIR REASONABLE CONTROL, INCLUDING, BUT NOT LIMITED TO: ACTS OF THIRD ERRORS IN THE CONTENT OR THE SERVICE FAILURES NETWORK, COMPUTER FAILURE INTERNET SOFTWARE OR ERRORS hardware, VIRUSES AND OTHER ATTACKS SYSTEM SUSPENSION OF WORKING SHIFTS, RIOTS, ACTS OF GOVERNMENT, NATURAL DISASTERS, ACTS OF TERRORISM, FAILURES IN THE LINE OF COMMUNICATION OR THEFT OR DESTRUCTION, OR UNAUTHORIZED ACCESS TO OR ALTERATION OF ‘ USE OF RECORD.
THE ABOVE LIMITATION SHALL APPLY NOTWITHSTANDING (I) LIABILITY ‘OR DAMAGES THAT YOU EXPERIENCE FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER THEORY OR CAUSE OF ACTION, AND / OR (II) THE PARTY THAT CLAIMS RESPONSIBILITY’ PRE OR DAMAGE WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
